What is important is that Club La Bourse is a scam, and you'd have to be a moron to sign up for it, given all the complaints that consumer groups in this country have been receiving about it for the past 2 years.

TO EVERYONE OUT THERE BEWARE AND BE VERY CAUTIOUS OF CLUB LABOURSE
I WOULD NOT WANT ANYONE ELSE TO GO THRU WHAT WE ARE GOING THRU TRYING TO GET OUR DEPOSIT BACK, THEY TOTALLY MISLED US ABOUT THE SAVINGS AND WHEN I DID SOME RESEARCH THE NEXT DAY, WHOT IF ACCOMMODATION WERE ACTUALLY CHEAPER
I EMAILED AND RANG THEM WITHIN 48HRS TO CANCEL MY MEMBERSHIP AND AM STILL TRYING TO SORT IT OUT, THEY WONT GIVE MY MONEY BACK EVEN THOUGH THEY TOTALLY LIE AND MISLEAD PEOPLE IN THEIR SEMINARS
DONT GET INVOLVED WITH THEM, IT IS NOT WORTH IT!!!!!!!!!!

I have to agree with you, it does appear to be a bit of a scam. My partner and I went to a seminar (4 couples) last week in Ascot Vale and were promised the $60 Myers/Coles gift voucher only to be told that after we had decided not to buy their time share package that they had run out of vouchers, there was only about 4 couples there, surely they knew how many to expect. Could they not have run down to the nearest Coles and buy 4 vouchers. I cannot beleive we were conned into going out in the freezing cold night and going to this sham. I particulary would not have attended at all if I had known they were selling time share, it actually states on their confirmation letter that "Club LaBourse is not involved in the selling of Timeshare or Property". They lost all credibiity when the price of the "timeshare" went from $11,999 down to an unbelievable $3,999 in a matter of minutes, how desperate are they! Do not waste your time.

can you tell me what venue in ascot vale you went too as i would love to distrubute flyers to potential customers of theirs on the nights they are there
trust me , they are the biggest scam operators, all they are interested in is getting people to pay that $ 1000.00 deposit from their high pressure selling tecqniques. i want everyone out there to beware of club la bourse and not get conned into this so called 'membership'
my c/card company credited my card after i sent them a very long letter but unfortuantely club la bourse sent them some copy of the 1999 trading act and managed to get the money back from my c/card. i will not give up on this
as it is just so wrong when i rang them within 24hrs to cancel what i had signed and basically they said tough luck and were quite rude on the phone
things must be tough for them now as when i went they were offering $ 100.00 coles vouchers
if they were sauch a great company they would not need to have these seminars and they would let people walk out and think about it and do a bit of research but they do not rreveal any proer prices until you have paid full membership and thats when people see they have so wasted there money.

The date was 9th July 2008 at The Adish Restaurant, Riverside Gold Course, 55 Newsom St., Ascot Vale. I have tried to contact them via email and also by phone to ask where the $60 voucher is, but no luck. The two emails I sent both came back with "no such email address". It certainly is getter more like a con every day.

...your info appreciated all- I received a phone call inviting me to the Ascot Vale venue on July 9- the $60 voucher incentive included- couldn't attend (even if I'd wanted to) because of work commitments- forewarned is forearmed if I'm invited again...thanks...

If consumers purchase goods or services costing $50.00 or more in the course of door-to-door trading and sign a contract, they have a 10-day cooling off period, by law. Door-to-door traders are required to give consumers written information outlining the right to cool off and a form to use for the purpose. Door-to-door trading includes contracts entered into at premises that are not the traderÂs premises and initiated by an unsolicited phone call.
ÂNo money or goods should exchange hands during the 10 day cooling off period. In cases where the company has failed to provide written cooling off information, or money, such as a deposit, is paid, consumers have up to 6 months to rescind the contract.Â

yes and i am one of those unhappy customers, everyone out there needs to be very wary of this club. they use very high pressure sales tactics but their prices are no cheaper than booking direct. i have put a formal complaint with consumers affairs and i think others need to do the same and maybe something can be done. i want my deposit back, i cancelled within 24hrs but they refuse to do anything
i am very very disappointed in this club!!!!!!!

leephills, you've joined the other club: those trying to clawback their dosh.Cooling off ? People who took your money deny/ignore the law and Tribunal orders.Once you've had your Tribunal order,unless your credit provider plays ball, it'll cost you > $300 to send forms to QLD. Club LaBourse recently announced its Australian Membership reached 8 000. (Of course some of us rather would not be members.)At a guesstimate of $4K/member, that'd be $32 million. 80 % of that to resellers would be $25.6 million.Could the resellers have a closer relationship to their principal than we've been told ?

I dont believe it...we just came back from the Club LaBourse seminar at Ascot Vale tonight (23/7/08) and the same trick was pulled on us - they supposedly ran out of Coles/Myer vouchers so no $60. What a scam.

I too went to one of the seminars at Ascot Vale last month.

We were unfortunately lured with the promise of wholesale prices and that they would beat any quote by 10%. We paid on the day and were silly enough to tick the box that says "I acknowledge that there is no cooling off period". I'm not even sure if you are legally allowed to put that in a contract.

Anyway, we are in the process of getting our refund back. We've written them a letter and if they do not comply, we will be lodging a formal complaint with Consumer Affairs.

Looks like it's going to be a long battle ahead.

dont be too confident about getting a refund, i too have gone thru exactly the same thing, i unfortuantely got lured into it a few months ago. they refuse to give your money back, i had various letters and emails backwards and forwards, and then sought help from my c/card company who did actually refund me but now and charged my card again as la bourse came back at them saying there was no cooling off period)(legally i am 99% they cant do this when they were not in their own premises as basically this is classified as door to door trading.
anyway i have now sent consumer affairs all the details how they totally misled and lied to us about the savings.
i cannot believe we got conned into this, generally if something sounds too good to be true it is, and it certainly was.
dont give up, put your complaint in as soon as possible with consumer affairs, the more complaints they get the better about this shocking company.

Depending on what state you're in, and depending on what the good or service is, it is legal to create a contract which waives your cooling off period. So, sadly, it is possible that Club LaBourse issued a legal contract.

A dodgy, scam artist, spiv merchant contract, but legal, nevertheless.

hc_andy, you haven't the foggiest of what's against you. Regardless that legally you can't waive your rights, you'll be denied them. Would like to know source of aaronzig's contrary stance. Whom to was your money paid, and what appeared on your credit supplier's statement ?Name them all as respondents, if you can find their legitimate street addresses. Lodge your complaint now (preferably much sooner). The usually successful Tribunal order may allow your credit provider to reverse the debit, despite leephills' experience: otherwise, you're most likely as stuffed as done by a taxidermist.

Apologies. I was looking at the wrong act. You can waive the cooling off period on certain things like conveyancing and car sales (In NSW).

But not in door to door sales, which is what Club LaBourse is.

Hi jad81887 and all,

We've forward CLB a letter seeking a refund in 14 days.

From your experience, is it best to lodge a complaint with Consumer Affairs now or give CLB the right to respond first?

Secondly, are there certain steps you need to take in succession before finally lodging a complaint with VCAT.

eg:

1/ write letter to CLB seeking refund
2/ if no reply or no refund being offered by CLB, lodge complaint with Consumer Affairs.
3/ if Consumer Affairs can not help then lodge a case with VCAT.

Is that how it goes or can we jump straight to lodging a case with VCAT???

You won't receive a sensible/useful reply, if any.
What address did you use ? You need a street address to lodge complaint with VCAT: check that 'site for what's required, but don't delay in lodging complaint once you have all the required info.
Good luck, which you'll need in abundance.
