Cops accused of 'fixing' mate's breath tests

They work side by side in remote police stations, but yesterday the corrupt nature of the relationship between some police officers and Corrective Services staff in country areas was exposed.

A NSW Police Integrity Commission hearing is investigating at least two cases of alleged corruption involving policemen "fixing" random breath-test results for their mates in Moree and Orange.

One of the incidents involves a senior officer's son who was pulled over in Orange in December last year with a high-range blood-alcohol level, but released after a follow-up breath test in the police station recorded a reading of zero.

In a similar, but not connected, incident the PIC heard how supervising policeman at Moree Phillip Smith admitted blowing into the station's breath analysis machine to record a blood-alcohol reading of zero for Corrective Services officer David Webb, who was arrested for drink-driving.

Webb recorded a roadside blood-alcohol reading of 0.095 after he was pulled over by Constable James Boaden on September 24, last year.

The warden allegedly asked Boaden: "Can't you give me a break, I'm with the CSU?"

Boaden took him back to the station to charge him but another Corrective Services officer recognised Webb.

Webb phoned his boss Assistant-Superintendent John Weavers who allegedly contacted the higher ranking Smith and instructed him to "find someone else to blow into the bag".

The inquiry heard Weavers then phoned "the most senior police officer he could contact", Inspector Jeffrey Budd, to inform him of Webb's arrest.

Boaden said when Budd called the station, Smith hung up and said: "We've been given the green light."

Smith and Boaden then waited 1 1/2 hours to "time him out" - or allow the level of alcohol in Webb's body to decrease - before retesting him.

previous history of disagreements between the two of us, in as much that he used verbal intimidation on me ... (and) threatened me with physical violence," Const Boaden said.

On one occasion, he claimed Insp Budd told him he would, "rip off ya *** kin' head and *** down your throat".

Const Boaden said he would have charged Mr Webb if he thought Insp Budd had not approved his actions to release him.

A NSW police officer says he faked a breath test to help a colleague's son dodge a drink driving charge because he "felt sorry for him".

Senior Constable Mark Christie told the Police Integrity Commission (PIC) today he acted alone when he decided to protect Adam Clunes, the son of Leading Senior Constable Colin Clunes.

Mr Clunes, 19, blew 0.202 in a roadside test after being pulled over by police at Orange, in central west NSW, in the early hours of December 21 last year.

Snr Const Christie said he was the on-duty breath analysis service (BAS) operator at Orange police station when Mr Clunes was brought in for further testing.

He told the commission he blew into the BAS machine instead of Mr Clunes, but said it had nothing to do with Snr Const Clunes.

He said it was the first time he falsified a breath test in 10 years as an officer.

However, he said his perspective on life changed after he was assaulted by a prisoner and suffered concussion just days before Mr Clunes' arrest.

"I began to feel very much different about life,'' Snr Const Christie said.

He said his actions were "something that arose in me that night'', and the thought to blow into the BAS machine himself and fake the result was spontaneous.

"The young fellow was in great peril of losing his licence, his job, his career,'' Snr Const Christie said.

"I felt great empathy for that.''

Snr Const Christie apologised to the PIC for his actions and the disgrace he had brought on his colleagues and the NSW Police Force.

"I acted alone. I haven't needed to collude with other police. It was a poor decision made on the night,'' he said.

He told the inquiry he was suffering from a stress condition and arresting officer Constable Kate Lanser was "hysterical'' when she bought Mr Clunes in, due to his father being a senior colleague.
Const Lanser earlier told the inquiry Snr Const Clunes was very upset in phone conversations she had with him following his son's arrest.

She said she felt he implied she should not charge Mr Clunes because he would lose his licence and possibly his job.

Phone records tendered at the inquiry showed eight calls between Const Lanser and Snr Const Clunes in the hour between Mr Clunes' arrest and when he was released.

Snr Const Clunes told the commission he expected his colleagues to follow standard procedure, but admitted he may have asked Const Lanser to "do something''.

But he said the last thing he told Const Lanser was "do what you've got to do'', meaning follow correct processes.

Snr Const Christie said he did not believe Mr Clunes was affected by alcohol to the extent his roadside test suggested.

He said the teenager stood unaided, had clear speech and showed dexterity in removing a chain from around his neck.

On a police document relating to Mr Clunes' arrest, Snr Const Christie wrote that Mr Clunes had swallowed a mouthful of rum and coke before getting into the car.

He said in the document that Mr Clunes was scared to tell police about the swig of rum, which may have affected the roadside test results, because he was on a provisional licence and not entitled to consume alcohol while driving.

Mr Clunes also used this explanation to his father on why his final blood alcohol test had come back negative and he was released without charge.

Anti-corruption watchdog enhanced: Debus
The Rudd government has rejected claims it hasn't given enough teeth to a national anti-corruption watchdog of policing authorities.

Labor, when in opposition, said the Australian Commission for Law Enforcement Integrity - set up by the previous Howard government to covertly investigate corrupt officers in the Australian Federal Police and the Australian Crime Commission - was grossly under-funded in comparison to state-based anti-corruption bodies.

It has been suggested a 10 per cent increase in funding for the commission represents a broken election promise by Labor.

Home Affairs Minister Bob Debus rejects the charge and says the opposite is true.

"To the contrary, its (the commission) budget has been nearly doubled," he told reporters.

"The previous government under-funded that particular org *** ation and, according to undertakings that the new government had made, we did, in fact, double the budget."

The commission's abilities to investigate had been enhanced, he said.

Opposition justice spokesman Christopher Pyne later accused the government of having an obsession with tokenism and spin on matters of national security.

The budget revealed the commission was been crippled by under-funding, he said.

"Media reports indicate that a former head of (the commission) said the body needed a 10-fold increase in investigation staff and substantial extra funding to be effective," Mr Pyne said in a statement.

"The same reports suggest (the commission) will be unable to perform duties such as wire tapping and covert operations, essential to root out corruption.

"While the Rudd government trumpets increases to the size of the AFP ... they are failing to resource agencies who watch the watchers."

This lack of proper resourcing for oversight agencies had real consequences, Mr Pyne said.

"In this case, those consequences pertain to the credibility of our national security agencies."

National anti-graft body left toothless

The national anti-corruption watchdog will be unable to fund covert investigations of corrupt officers in the Australian Federal Police or the Australian Crime Commission after the Government broke its promise to give teeth to the new body in last week's budget.

The move means that the fledgling body - known as the Australian Commission for Law Enforcement Integrity - will be unable to conduct telephone taps or set up its own covert investigations unit at a time when the size and powers of the AFP and ACC have been greatly expanded.

This lack of accountability comes at a time when public confidence in the AFP and its chief, Mick Keelty, has plummeted following the bungled handling of the Mohamed Haneef case.

Despite a pre-election promise to deliver substantial new resources for the ACLEI, last week's budget delivered only a token funding rise - less than 10per cent of what the former head of the ACLEI has said is necessary to make the new body effective.

The ACLEI was established by the Howard government in late 2006 to root out corruption in the AFP and ACC but was given an annual budget of only $2million - a figured dwarfed by budgets for the state-based police anti-corruption watchdogs, which receive between $19million and $34 million a year.

The then acting head of the ACLEI, John McMillan, told The Australian in July last year that the ACLEI was unable to do its job with such limited resources and needed a tenfold increase in investigation staff and substantial extra funding to be effective.

The Labor Party, then in Opposition, agreed with Professor McMillan and promised to deliver the necessary resources.

But the budget last week failed to deliver on those promises, lifting the ACLEI's budget by only $750,000 in 2008-09 to $2.82 million, along with a one-off capital injection of $750,000.

This will allow the ACLEI to employ only three new investigative staff, taking the total to 12.

This came despite the Government boosting funding for the AFP by about $400 million, taking its annual budget to about $1billion, with the extra money to be spent on employing about 500 extra officers over five years.

Professor McMillan declined to comment, but he said last year that the ACLEI needed a staff of 50 if it was to exercise the powers it had been given, such as telephone interception and controlled operations.

The budget also promised an extra $2 million in funding for the ACLEI in each of the three years after 2008-09, but this amount still falls far short of what the ACLEI needs to hold the AFP and ACC accountable.

A spokeswoman for Home Affairs Minister Bob Debus maintained that the ACLEI had enjoyed a "significant increase' in the budget, which "shows that the Government is committed to ACLEI".

The ACLEI's chief, Integrity Commissioner Philip Moss, did not return The Australian's calls. But in Senate estimate hearings last month, he admitted that the ACLEI did not have the resources to conduct proper investigations of suspected corrupt officers.

"It will be a quantum leap for this org *** ation ... if we get to the stage beyond responding to notifications and referrals and get to the point where we more pro-actively engage these intrusive powers in the detection of corruption and corrupt conduct," Mr Moss said.

Cop blames brain tumour in sex case

A Surfers Paradise policeman sacked for engaging in a sexual act with a female drug suspect and then giving her confidential information has applied to use fresh evidence that he was adversely affected by a brain tumour at the time.


Former Queensland senior constable Peter Chapman, who worked at the Surfers Paradise Juvenile Aid Bureau, was dismissed in 2006 after the Misconduct Tribunal found him guilty of accessing police databases outside official duties, releasing information and having sex with the woman, who was a domestic violence complainant.

The tribunal found he had accessed information about a drug operation and passed it on to the woman whom he suspected was involved in drug trafficking, who in turn told a third person with links to the Finks motorcycle club.

During a judicial review of the case in the Supreme Court in Brisbane last year Mr Chapman admitted he had sexual relations with the woman but claimed she was an informant and he had only accessed the police database to confirm things she had told him about a man charged with drug offences.

That review was adjourned and after almost a year in delays, barrister Paul Smith yesterday applied to have fresh medical evidence -- that Mr Chapman had an undiagnosed brain tumour at the time -- admitted as part of the case.

Mr Smith read a doctor's report which stated the tumour had been undetected for some time before 2004, when the offences took place.

The court was told various brain scans showed Mr Chapman had had a tumour in the frontal lobe, which was the area responsible for short-term memory, inhibition control and behavioural functions.

Mr Smith quoted the doctor who said he believed Mr Chapman's 'thought processes had been significantly impaired' by the tumour.

Mr Smith said the court should send the matter back to the tribunal for reconsideration.

Peter Callaghan, SC, for the Crime and Misconduct Commission argued the medical report was far from conclusive and the doctor would need to be cross-examined to determine if the brain tumour theory was worthy of the court's consideration.

He further argued that time limitations and procedural laws restricted the tendering of new evidence.

Justice Jim Douglas reserved his decision about the admissibility of the medical report.

Cop playing the health card to avoid sacking

A cop under investigation over an org *** ed crime murder wants to retire with a disability pension before he can be sacked on discipline grounds.



Victorian Detective Sergeant Peter "Stash" Lalor (pic above) was suspended on full pay eight months ago after the police taskforce Operation Briars linked him to a hitman who confessed to the murder of male prostitute Shane Chartres-Abbott.




Chartres-Abbott was shot dead in June 2003 as he left a Reservoir house on his way to the County Court where assault charges against him were being heard.




The hitman, who has since pleaded guilty to the murder, has claimed Sergeant Lalor provided him with the address of the victim and helped set up an alibi.




While under investigation over alleged criminal conduct, Sergeant Lalor was charged with the sackable internal offence of disgraceful conduct.




The discipline charges relate to a series of malicious internal police emails allegedly sent by Sergeant Lalor to attempt to discredit the then president of the Police Association, Sergeant Janet Mitchell, as part of an internal union power struggle.




Sergeant Lalor has been identified as the author of the emails, sent under the alias of Kit Walker.




The discipline hearing was due to be held before Assistant Commissioner Stephen Fontane on March 24 but was postponed when Sergeant Lalor produced a medical certificate declaring he was too ill to attend.




He has since applied for long-term sick leave, which would ultimately result in him being granted a police disability pension of 80% of his wage.




Senior police have long believed that some police suspected of corrupt behaviour have used the sick-leave system to avoid discipline hearings.

In an Office of Police Integrity report on the police internal discipline system, the then dir- ector George Brouwer found, "One way members avoid disciplinary proceedings is to leave work on WorkCover, or take sick or other leave.




"When this happens, it can be very difficult, if not impossible, to tell whether the member is suffering a genuine stress-induced medical condition or is malingering to avoid the consequences of the hearing … Sadly these tactics are often successful, reflecting poorly on the integrity of the system, as much as the integrity of the member."




Sergeant Lalor will be examined by a police medical officer, but in previous cases it has proved impossible to overturn the initial doctor's decision to grant a long-term certificate.




A police spokeswoman said she could not comment on individual discipline cases because of privacy considerations.




A friend of Sergeant Lalor's who is also under investigation by the Briars taskforce, former detective sergeant David "Docket" Waters, went on stress-related sick leave in 2000, and was granted a police disability pension.

A former Victorian police officer claims he has been a victim of corruption and cover-ups at the highest levels of the force after blowing the whistle on detectives allegedly fabricating evidence to obtain court warrants for listening devices.

Gerry McHugh is demanding an independent review of the decision by Victoria's Office of Public Prosecutions not to prosecute two detectives after a four-year internal inquiry recommended they be charged with 11 offences, including attempting to pervert the course of justice.




The investigation found that supposed evidence used in sworn affidavits lodged in the Victorian Supreme Court to obtain warrants to bug Mr McHugh's home and cars included information that came from a clairvoyant and tarot-card reader.




Mr McHugh's call for an independent review has been backed by the officer leading the internal investigation, codenamed Operation Trencher, who told The Australian newspaper he and other investigators were "concerned about the reluctance of the OPP to prosecute". "We can't understand why it's not being prosecuted, given it is in the public interest," Detective Senior Sergeant Bill Nash said.




Mr McHugh was a detective in the northwest Victorian city of Mildura when he discovered his house and cars had been bugged in 1999 as part of a police investigation into allegations another detective was involved in two murders.




Mr McHugh did not know Denis Tanner, the detective allegedly involved in the murders of Jennifer Tanner in 1984 and transsexual prostitute Adele Bailey in 1978. He was subsequently cleared of any links to Mr Tanner or any involvement in the murders.




Mr Tanner was named as the killer of Jennifer Tanner by a Victorian coroner in 1998, but was never charged and denies involvement in both murders.
