Coalition frontbencher Tony Abbott says New South Wales is playing nanny state politics with its ban on smoking in cars when children are present.

The former federal health minister has told a public health debate at Sydney University that smoking in front of children is a trivial issue and states should not intervene.

The NSW ban comes after similar moves in South Australia and Tasmania, with other states expecting to follow suit.

Anyone caught smoking in their car with a child as a passenger now faces a $250 on-the-spot fine.

Mr Abbott says the ban is over the top.

"I was a child that was regularly imprisoned in a car with heavy smokers," he said.

"My parents both smoked heavily when I was a kid. Now has it done me any harm?

"You be the judge... maybe I would have been six foot six and I would have had much greater intelligence, who knows?

He's not advocating you smoke in front of your kids, just that the state govt shouldn't mandate against it.

I see bogan mums all the time crossing the street with a durry hanging over the pram for the wee bogan to inhale.

He's not advocating you smoke in front of your kids, just that the state govt shouldn't mandate against it.

Its not about the "bogan mums", its about the poor bloody kids, they dont get a say in this. This legslation is about protecting children, not about stripping the rights away from people.

Dont believe me, try explaining to your 12 year old brother why your mother died of cancer.

But there IS a point about parental responsibility here. The state takes over, so parents don't have to make choices for their children. Of course children should not be subjected to smoke in enclosed spaces, but the parents should be excercising responsibility for the health of their littlies - It's called love.

How will they police it ? I still see heaps of people driving and holding mobile phones up to their ears. In fact I've even seen them driving with a phone in one hand and a f ag in the other.

We don't live in a perfect world Corky. Witness QV's bogan mum statement. We all know of parents like this.

Murders are still an everyday occurence too. Maybe we should sc rap that law?

After 25 years, I stopped. Some of my teeth are now falling out as a direct result, I hope this is the worst that happens from it. I try not to be too "reformed" about it...

I think the Government is very happy to make a lot of money from heavily taxing smokes. They are doing nothing to prevent new smokers taking up the habit as soon as they turn 18 (or look 18 to the shopkeeper).

I would suggest that if there was any genuine will to reduce the numbers of smokers, the minimum age would go up by a year each and every year, smoking products would be by doctors prescription only, and the products to give up the habit would be as heavily subsidised as smokes are taxed.

But no, as usual, the bean counters have found a new way of making money. Thats all it is, money.
