SAN DIEGO COURTS: A man who sneaked a small bag of feces into a courtroom during his robbery trial, smeared the contents on his lawyer and threw it at jurors, was sentenced yesterday to 31 years and four months in prison.
Weusi McGowan, 38, pleaded guilty to robbery and residential burglary in connection with the original case, and two assault charges in connection with the feces-flinging incident.
San Diego Superior Court Judge Frank Brown sentenced McGowan yesterday. Brown recommended that McGowan be housed at the California State Prison in Lancaster, which a defense attorney said was better suited to handle McGowan's mental health needs.
McGowan was tried in January on charges stemming from an October 2007 robbery in Barrio Logan. According to court documents, McGowan demanded money from a 54-year-old man and hit him with a rock inside a sock.
During jury selection, McGowan asked Judge Jeffrey Fraser to declare a mistrial because he believed members of the jury had seen him in restraints while being escorted into the courtroom, according to court documents.
Fraser spoke to the four jurors in question, dismissed them, then allowed jury selection to continue.
Three days later, when the trial was under way, McGowan pulled out a bag he had hidden in his clothing, rubbed excrement on his lawyer and threw it at jury members as they were filing out of the courtroom.
The excrement did not hit anyone in the jury box, but some landed on a computer case that belonged to one of the jurors. |

SAN DIEGO - A mistrial was declared Monday when a home-invasion robbery suspect smeared human feces on his attorney's face then threw more at the jury.
Weusi McGowan, 37, was upset because San Diego Superior Court Judge Jeffrey Fraser refused to remove Deputy Alternate Public Defender Jeffrey Martin from the case, prosecutor Christopher Lawson said.
At the mid-morning break, McGowan produced a plastic baggie filled with fecal matter and spread it on Martin's hair and face, then flung the excrement toward the jury box, hitting the briefcase of juror No. 9 but missing the juror himself.
"That juror didn't even see it coming," Lawson said.
The prosecutor said the defendant was compliant after the outburst and was taken into custody without further incident.
After lunch, Fraser dismissed the jury, telling them McGowan would have to get a new lawyer and that his trial would be delayed.
The judge scheduled a status conference for Feb. 9 and raised the defendant's bail from $250,000 to $1 million, finding he is a danger to the community.
Lawson said McGowan originally became upset last week when he claimed one of the jurors saw him in shackles as he to the courtroom. Fraser dismissed all jurors who saw the defendant in shackles, the prosecutor said. |

The judge ordered the defendant to pay $129 to a juror whose briefcase was ruined by McGowan's feces. No jurors were hit by the defendant's fecal matter

I can see the dilemma, when cleaning up the lawyer, it would be nearly impossible to distinguish between new poo and original shit. |

Only seems fair, I mean lawyers have been sh1tting all over us for years...and charging $600.00 an hour for the privilege.
In fact I have long had a saying that still holds good today and goes "lawyers? I sh1t 'em" to which the stock reply is "well can you sh1t me one, mine is fkn useless" |

Ahhhh, so you use one of the 'pensioner special' fraternity then ?? Most of the ones I know expect something over $1000 an hour (and that doesn't take account of the discrepancy between hours worked & hours billed. Most trades can only bill a fraction of hours actually worked, but lawyers traditionally bill at least 150% of hours worked. |

I am a Kiwi.
If I was offended by what illbeback had said, I would have a) ignored him b) told him so c) reported him for abuse d) all of these.
With the utmost respect for you and your job which at times must be so crappy, loosen up a bit. Most of us are adults here (yes, I know, at times that is VERY hard to believe ) and could make our own decisions about posts we find offensive.
(unless we start howling "where are the bloody mods and why haven't they done something about (insert ID here)".
