The following tragic story tells of how one young mans life was cut short by a punch thrown by another young man in a moment of rage. It is tragic for the young mans family who died but equally tragic for the young man who threw the punch. This young man is no thug and now has to live his life with the consequences of this fatal reckless act. The worse thing now is to send him jail. A more suitable penalty is to give him a suspended sentence. Why destroy his life and his families for one reckless fatal incident???
I know. I was involved in a similar incident at the same age. Young men fighting dont intend to permanently hurt the other person and certainly dont intend to kill them. They just want to prove who's tougher.
Dont destroy another young life with a jail sentence.

A TEENAGER accused of the manslaughter of budding football star Sam Davis has been committed to stand trial in the District Court.
Heath Arthur Clake today appeared in Adelaide Magistrates Court charged with the manslaughter of Sam Davis, 17.
Davis died days after allegedly being punched in the back of the head at a party at Brighton in May.
The court has previously heard Clake assaulted Davis during a melee that had evolved from a trivial dispute about surfing.
It is alleged the freak punch severed a crucial bone in the spine of the teenager, who spent less than a day on life support before he died.

Unsure how I feel about this matter, but probably agree about not sending the perpetrator to gaol . I felt repulsed though by the photo of him appearing to be poking his tongue out at the media. This is the most serious of offences after all - a young life has been lost and the family/friends of the deceased young man will never get past that fact.

Some might disagree with that statement especially as he punched the other guy in the back of the head which suggests that it might have been a cowardly king hit from behind, kinda like shooting someone in the back.

Whilst I agree that it would be tragic to destroy this young mans life there must be some sort of severe penalty for the taking of a life like that.

I've just read the article from the Adelaide newspaper and this clown was breaching his bail conditions from another incicent by being at the party and was supposed to be wearing an electronic monitering device and living at his folks house because of a previous incident that he had been involved in. All of a sudden this guy's profile becomes a bit more sinister and perhaps a jail term moght be the only way to go.

This man is on bail for assult... may be if he has been remanded in gaol untill this assult charge was heard a young seventeen boy would be alive tonight

Just maybe two or three weeks locked up with some rules and dicipline may have made him think before striking out and king hitting this young in the back of the head a cowardly action.

One wonders what sort of parents he has... possibly the type who have never given the perpurtor any rules or made him accept responsability for his actions.. there are so many parents out there today trying to be friends to their kids instead of mentors to them.

I have seen parents lie and give in and will do anything rather than let their kids face responsabilities for their actions so they continue to do the same things over and over again.

My grandson was bailed to at 18 for assult.. not on braclett but his curfew was at 9.00 pm, when he was with his parents they knew he was sneaking out and breaking his previous bail conditions and got into troube again,the police would not allow him to be bailed again to his parents so I went bail for him ,in the second week he was bailed to me at 9.10pm he was not home and I reported him to the police to prevent him from getting into more trouble, and the police were waiting for him when he arrived home at 9.30 pm they cautioned him and that was the last time he broke bail... because I love him and had to protect him from himself and from the thugs he associated with ...I told him the rules when he came to live with me ,he broke the rules and my trust and if he had to be locked up again so be it.

He spent 4 months with me ,got a suppended sentance of 2 years for the assult charge ,moved away from his parents and touch wood hasent ben in trouble since.

It's called tough love it hard to administer but only good can come from it and now he thanks me and rings me every week.

This guy untill he has his freedom taken from him and does some time in gaol he will always offend

well we dont know exactly what happened...but i would reckon that as with all young men brawling they dont think of the consequences of their actions and certainly dont intend to inflict lasting harm on the other person...a suspended sentence is appropriate and lets hope he turns his life around...

lets not get on your high horse and point the finger...this young man has the full support of his parents with his mother accompanying him to court which says to me that he comes from a close caring family...

i'm with you southern, just because someone does fight someone at a party, don't mean the parents had no rules or boundries or any discipline. Its not always the case in some circumstances, see what mum and dad don't know don't hurt!
as for the topic, I think that if he really is going out n partying whilst on bail and acting up then he shouldn't be released lightly. Yes ok it'll be hard for him to just be at home 24/7 but with every action is a reaction, and just had his luck down that night.
But I also do hope for this bloke to come out of it all in the end all fine!

"A 16-year-old Melbourne bashing victim is fighting for his life in hospital.

Police say the boy, a guest at a 16th birthday party, was one of about 15 people involved in a brawl in a car park at the back of the house in North Balwyn, in Melbourne's east, about 11.30pm (AEDT) on Friday.

He was knocked out by a punch but later regained consciousness and was driven home by a friend.

However, his parents were unable to rouse him the following morning and he is now in the Royal Melbourne Hospital on life support with a serious brain injury."

Another life lost. These kids all need a reality check, i.e., punches kill people. And guess what, if you do kill someone then YOU need to take responsibility, whether it be manslaughter or murder, and suffer the legal and moral consequences.

we have the same over here a lovely boy in hospital-17 years old on life support-2 tests show no brain wave activity-parents hoping for a miracle!
Stepped in to break up a fight and belted over the head with a branch.

We have the one punch rule coming up in WA-has been delayed because of parliament change.

they also advertised on tele; that just one punch can kill-thereby negating the usual defence; that the killer could not have known a punch would kill his victim

most??? really, news to me. regardless, they do need to be educated on the topic, ie, fists can kill, one punch can kill if it hits the right spot or if someone falls to the ground and their head hits the concrete. all you can do is try and educate people, as futile as it may seem in some instances.

A Victorian teenager who punched a partygoer causing him to fatally hit his head on concrete, has been sentenced to youth detention.

Ryan "Jack" Ellis, 17, fractured his skull and suffered a brain injury after the punch at a party in October 2006 caused him to fall backwards and strike his head on the footpath.

He died two days later in hospital.

The Victorian Supreme Court Friday heard Mr Ellis, of Stawell, had confronted the teenager, known only as EJC, outside the party calling him a "c*** of a bloke".

EJC stepped forward, grabbed Mr Ellis by the collar region and delivered "one or two" blows to his face, the court heard.

Sentencing EJC, Justice Robert Osborn said he was satisfied it was dangerous for EJC to punch Mr Ellis.

"It was you who chose to come to grips with Ellis," Justice Osborn said.

"However abusive his language, he had offered you no violence."

Justice Osborn ordered EJC, who was found guilty by a jury of manslaughter, to serve three years in a Youth Justice Centre.
