A POLICE officer was "going off his head" when he "drove two boots" into the head of a drunk in custody, a witness has told a Northern Territory court.

Sergeant Michael James Bourke, 34, has been charged with three counts of aggravated assault at Tennant Creek Police Station on November 25, 2006.

He is also accused of attempting to destroy video evidence of the alleged attack on Graham Kurnoth, who allegedly was handcuffed, dragged across the floor and repeatedly kicked in the head.

The 31-year-old, who was known to have an infectious disease, had been taken to the watch house to sober up earlier that day.

Witness Lance Hopkins, who was sharing a cell with Mr Kurnoth, told the Supreme Court in Darwin today he could not recall him spitting at police.

"(Sgt Bourke) drove two boots into his head, he was swearing and at that moment going off his head," he said.

"He gave him a couple of not very hard kicks?" Defence Lawyer Peter Elliott asked.

"They looked pretty significant to me," he replied.

Mr Hopkins said Sgt Bourke used swear words "60 per cent of the time" and was yelling and screaming.

Grant Menzies, who was working as an officer in Tennant Creek at the time, said Mr Kurnoth was spitting blood after he helped Sgt Bourke move him to another cell.

But, he said: "I didn't see any kicks".

"As we were taking him out the door his head hit the side of the door," he said.

"Was that an accident?" he was asked.

"I believe so, yes."

Mr Menzies said Mr Kurnoth threatened to kill him when he arrived at the watch house and called him a "white c***".

He told the court he alerted Sgt Bourke to the fact that cameras in the cells had recorded the transfer.

"I said to him: 'That will all be on tape'," Mr Menzies said.

The trial before Justice Dean Mildren continues.

The assaults are alleged to have occurred on Nov 25, 2006 when Mr Kurnoth- who was in protective custody for drunkenness- was being transferred between cells in Tennant Creek watch house. Constable Del Nido agreed with defence lawyer Peter Elliot that Mr Kurnoth was a bucket load of trouble and that he had had to be manhandled earlier that day because he was not being compliant. She also agreed with Mr Elliots assertion that Sgt Bourkes kicks were not likely to cause any sort of major injury.
Mr Elliot said Mr Kurnoth had police alerts about possible HIV and Hepatitis infection, and that he was a known spitter. Sgt Bourke has pleaded not guilty to all charges.

And I've never ever heard of anyone from Ngukurr (aboriginal) who has bashed his wife with a star picket while drunk. Or any other offence either. Ahh, the serenity.
Do you happen to live underground, or have cataracts totally eliminated your sight? Perhaps both.

a bloke in Alice Springs beat his girlfriend to death with a VB stubbie, one charming bloke threatened to kill me with a knife when i was eating at the sports bar with my fiance, as i would not give him a smoke. the fact that I have never smoked simply made him call me a white not so nice person, then when he actually pulled his knife out, i beat his head in, I was the bad guy.

Replying to Greyman;
Most people who live in the NT understand how 'some' Aboriginal people are more likely to turn to violence, at the drop of a hat, than your average Aussie. This is because Aboriginal culture, the real one which is still practiced up here in the NT, is based on violence.
Unfortunately there are also quite a few, 'mainstream Aussies,' who work in, or for, Aboriginal communities, and therefore are unable to tell the truth about this violence in the communities because they can be kicked out for doing so. Some of these people are in 'important jobs' and are making a good living there, which is all the more reason they have to 'toe the line' when it comes to reporting community life.

Silly Niggaa deserved it, they are too dumb to do as they are told and violence is what they are used to, day in and day out. That nigaaa will now claim victims of crime and cost the taxpayers several thousand dollars and then thousands more to train a new policeman all because a drunk niggaaa was being non compliant. So what good did that do for the community, none, except cost taxpayers thousands more dollars for a complete waste of space that got drunk in the first place on taxpayers dollars and who will continue to do so throughout his sorry life when he is not sitting in a jail cell, being fed and clothed and cared for by tax payers dollars.

As Steve well knows, in Darwin, nearly every week, a usually white, woman or girl is sexually attacked by an Indigenous male.
I fully expect that in the Aboriginal camps around Darwin there are many more assaults which go unreported.
