2 women robbed at knifepoint in city

October 19th, 2009

TWO young women were robbed at knifepoint in Darwin early yesterday morning.

The interstate visitors - aged 20 and 25 years - told police they were in Smith St Mall near the water fountain when they were approached by a group of four to 10 men of Aboriginal appearance at 3.20am yesterday.

Territory Duty Superintendent John Emeny said the men allegedly behaved in a threatening way before one man pulled a knife on the women.

"One of the males drew a kitchen knife before stealing both of their handbags," Supt Emeny said. "Both women were deeply traumatised obviously and could only provide brief descriptions."

One of the men was described as wearing a blue singlet, while another was wearing a red T-shirt.

Casuarina detectives are investigating and are calling on anyone who may have seen the men to step forward.

People with any information are urged to ring police on 131 444 or Crime Stoppers on 1800 333 000.

The 18-year-old male - who is known to police - told police he got into a fight and had been glassed in the neck with a bottle.

The incident happened at the Rapid Creek foot bridge about 9.15pm on Monday.

The young man was taken to Royal Darwin Hospital where he underwent surgery yesterday.

They are expected to talk to the victim today pending how his recovery is going.

A PETROL sniffer who assaulted his traditional mother, his brother, two police officers, a prison officer and a fellow prisoner has been sentenced to three years in jail for the string of offences.

Geoffrey Ngadakarr Wanambi, 41, pleaded guilty to the seven violence charges, including locking his 66-year-old aunt, who is his traditional mother, in a room and hitting her on the head with a frying pan and kicking her with steel-capped boots.

He also launched an unprovoked attack on his brother and on police officers as they tried to arrest him.

In sentencing, Justice Judith Kelly said Wanambi had spat on and assaulted a prison officer and punched a fellow prisoner because he thought he was teasing him.

He has 15 convictions for assault, nine for assaulting a prison officer and two for assaulting a police officer, as well as 27 other convictions.

Justice Kelly said Wanambi posed a "real danger to the community and presents a serious risk of re-offending amounting almost to certainty".

When offenders appear in court charged with violent offences against others when intoxicated their bail terms need include conditions as mandatory of zero blood alcohol.

When convicted the sentences - bonds, custodial, parole, all need include several years of zero blood alcohol levels and their being subject to regular and random testing.

Such mandatory non-consumption periods need be for several years after released from custody after convictions.

IF they offend - breach the zero blood alcohol level, then perhaps prosecutions should include those who provide them with alcohol.

Need legislators write this into the legislation ?

Reading some Supreme Court decisions lately shows that these measures are in fact already in place, and are being used.

Pol, more on no alcohol clauses in sentencing.
The following is from a recent Supreme Court case, 12 Nov, sentencing remarks to Angus Pearson (Tennant Creek) who bashed his wife and broke her jaw when he was drunk.
~~

It will be a condition of your suspension that
you do not consume or attempt to purchase alcohol for the period of the supervision.
If you breach any of those conditions, and in particular, if you do consume alcohol,
you will be liable to be taken to prison and remain there for two years.

Such terms and conditions are common in cases making it to the Supreme Court.

Reducing the problem requires these be provided within standard terms and conditions for decisions made in Magistrates Local Court.

Should be an option to require in sentences for first offences except where violence is an issue, when such should be encouraged to be used.

Encouragement to Magistrates needs come from decisions of the NT Supreme Court, from Prosecution seeking such sentences at all court levels - including bail conditions, with clear support and leadership from the NTG, our politicians and the media.

Media should regularly question why such terms are not included in sentencing, or explain the Magistrates reasons for not including.

Clearly is frustrating for victims, Police and the community, after all the effort required to get to court and achieve a conviction, to see serious offenders without such sentences.

Needs become expected in wider community such offenses WILL RESULT in such sentences.

A MAN who stabbed a man in the cheek and threatened others after he was kicked out of a Territory pub had only been out of prison for seven months, a court has heard.

Jonathen Milingambuy Gurruwiwi pleaded guilty to 11 charges in Darwin Magistrates Court over the September offence on Monday.

The court heard Gurruwiwi had argued with his partner at their Nhulunbuy home, and went to the Walkabout Tavern for his first alcoholic drink since his release from prison.

Prosecutor Sergeant Richard Howie told the court Gurruwiwi was asked to leave because he was too drunk.

He left, walked across the road and got a knife.

As he walked back towards the hotel, he was nearly hit by a car. When it stopped he kicked the bonnet - causing $1000 damage - and reached in and slashed the driver's cheek, giving him a 5cm wound.

Sgt Howie said Gurruwiwi then walked to the security guard outside and threw the knife at him from about 2.5m away. He ran at the crowd controller and another man, who threw his portable radio at Gurruwiwi in an attempt to deter him.

He also threatened a night patrol officer with the knife.

In the early hours of the next morning when police arrived at Gurruwiwi's house to arrest him, he spat in an officer's face.

Gurruwiwi's Aboriginal legal aid lawyer Joshua Brock said the attacks arose from an ill-advised belief that he was being targeted by security staff because he was Aboriginal.

Magistrate Sue Oliver ordered a pre-sentence report and adjourned the matter until January.

Re:Another knife attack in suburbs. Reply to this message
IMHO we should amend the legislation to ensure where violence is involved the judiciary should be required when these preventative measures are not included they should state clearly why they are not being used.

Prosecution then should consider whether an appeal to higher judicial authority for inadequate sentencing should follow.

The politicians need to ensure the legislation reflects such sentencing as a priority in approach.

The benefit of such sentencing and early releases is that does NOT require those convicted remain in prison.

The benefit of making these changes to the Bail and NON Conviction orders, is these conditions should be deemed reasonable and acceptable whilst the legal issues are being determined.

Required is such orders much earlier at the Local Court level.

A man who indecently assaulted a woman on her way home from a night out- three months after his release from prison- has been sentenced to four years jail.
Adrian Dooley, 29, has spent more than 10 years in prison for the serious rape of a woman, and other violent offences.
He was released in March, and in the early hours of June 1 attacked a woman when she was on her way home from the casino.
Dooley pleaded guilty in the NT Supreme Court to grabbing the woman and pulling her into dark bushland. He touched her breasts under her clothes and simulated sex, straddling her.
The crown prosecutor said that Dooley had told the woman he "wanted to have sex with a white woman" and told her he had a knife, and would hurt her with it if she would not have sex with him.
He eventually let her go when he gave him $25 and a packet of cigarettes. His Aboriginal legal aid lawyer told the court his client had a "disturbing" criminal history, which included sexual offences and violent assaults on prison officers.
He asked for his client to be put on a partly suspended sentence, however the judge said it would be inappropriate.
Dooley received 4 years in prison with a 3 year non parole period.

As the offeder received 4 years in prison with a 3 year non parole period, will they actually do anything seriously to re-educate him to reduce chances he re-offends ?

Attitude: "once they are in there forget them"

is large reason have such high re-offender rates.

What are they doing to change their thinking...

Existing prisoner self-help courses on how to avoid being caught, how to avoid being convicted, are NOT a help !

We need reduce this contact, replace it with more educational and psychological counseling...
