Yes I agree with your comments.
Why are families being made to go to court and treated like criminals when they have broken no laws? Simply because it is there. Because it exists. And it is a court.
Why are we sujected to a court and all of the, at times apalling and at times just useless, time wasting date posting proceedures and proceses designed to make people's, especially children's, lives miserable for as long as possible, just so the court's people are paid more money? It is of course all about money.
Certainly it is "legal crime."
One party for "no reason at all" can take their family to court and wreak havok upon all their lives. The court then is empowered and commences its crimes against ordinary people.
That such powerful and all encompassing crimes are being committed daily and with total discretion and lack of transparency and no need for evidence is horrifying.
And the will of the magistrate rules. This magistrate or judge, who after all will be biased and have a personal set of values as this is inescapable, or a bad day, or an ex-partner who they hate who looked or sounded like you, will decide the way you are to live your life from the moment you enter the courtroom.
All decisions about your family life will then be in the hands of this perhaps less than all knowing, all caring person. Everthing of importance to you as a parent or child will be decread by that person with frightening speed.
With hardly any knowledge of the people at their mercy this person will make unbelievably rash, and sometimes purposfully vindictive decisions about the most important part of those peoples lives sometimes in the space of seconds. |

My heart goes out to you. I of course do not know your story but I know that you are a parent and I know that you must be dying not being able to see your child.
I also know that because decisions are made by the family court with such impunity and power but yet with such potential, in fact every liklihood, of being so incredibly wrong.
To my way of thinking, and I am just a mother, your child needs her father in her life and you have a right (natural if not legal) to share care and love of your daughter.
You would have to do something terrible TO YOUR DAUGHTER to forfeit that right, and anyway who proves that and who decides if it is true. Certainly not the family court with it's lack of need of proof or follow-up. |

I posted a new title suggesting the family court should close down and my words have been deleted even though that was the most that I said. Clearly there are people who do not want us to say such a thing.
I mean for goodness sake this is money we are suggesting taking off them!! This is very threatening to them! They just take our kids off us. |

| I am a mother of a 10 yearl old Autistic child. i have been fighting in court for 7 yeqars to protect my son from a violent and unbalanced man. his father. My son has been forced to be with him screamimg shouting hitting his father begging me not to go for years. yet..... The courts say children MUST have contact with both parents So realy its not about giving the mother what she wants far from it in this case. In some cases its the judge has already formed an oppinion befpte the case is run , money has exchanged hands illegaly or people have too much power and ruin childrens and peoples lives and do not care. Maybe they system should be put on trial i bet We would win. Wre all complain and get irrate about it but does anyone actulay do anything about it?????? Do we ban together and change this??? No we dont so who should we be blaming???? |

| The problem is not restricted to the ACT or the Family Court. Every state in Australia has major issues with child welfare, the vast majority stemming from the relevant Department of Child Safety. There are countless small action groups racing frantically in circles & certainly more than enough victims to force change, but the apparently insurmountable question is how to convince everyone to work together for the common good. |

The signs outside the Family Court buildings should say Men check your wedding tackle at the door do not expect it back.
Go on with a Y chromosome come out completely neutered.
I don't condone it but after I saw a very good friend of mine utterly torn apart, without deserving to be, by this system I do understand men that either top themselves or themselves and their kids. |

No you have no rights or freedoms under the constitution. The High Court at some point decreed that being a democracy (yeah right) implies we have a freedom of speech what the court giveth it can taketh away.
What got me was my mate was told he would be hit with a minimum of a $6000 fine if he broke any of the conditions of his access etc. Yet it was his ex that did what she wanted when she wanted and too hell with any court decision and did it with impunity. |

| Oh dear, sounds like no improvement since my divorce etc in 1976. We all have our stories eh. My ex had a psychiatric condition and it was dangerous for him to drive etc when unwell, however, the Family Court granted him weekend access from fri to sun night. He had tried to set fire to his car, left the children alone at shops etc etc etc. I had no objection to supervised access, but this was not granted. The children decided not to see him eventually as he was so unpredictable. He had been committed several times for trmt, but the court took none of this into account. Commiserations to anyone dealing with this authority. Children must be taken care of and their best interests served. |

In my case, the court appointed psych and the Judge made up their minds before we even entered the court room. It was so obvious. The Judge actually said in her summation "what a charming young man" when it came to my ex. This charming young man went to court 4 times with no intention of doing anything that was for the betterment of his children. Not once did he object to their mother having custody. He never saw them before the first court case (his choice) and only a handful of times after the fourth. In his eyes it was all about "control". I have custody of my beautiful children but he, through the Court, has dictated where we live, which school they go to, even though I can't afford the housing or the school, but he doesn't have to pay a cent to help raise them. He resigns from his work two weeks prior to every court appearance and then claims he has no job and no money. My financial situation was cast aside and I was literally forced to live of the kindness of my family and friends. I was belittled in Court, having the psych tell all and sundry that the only reason my children love me "is out of fear and obligation". I find it funny, how her comments hurt me the most, even now after nearly a decade.
The light at the end of my tunnel - my wonderful family and friends who paid for things I could not. They helped me raise the most wonderful children.
To the parents who are denied access because of a system that doesn't care, and ex's that use the Court for twisted personal revenge .... don't give up. |
