loraw,

depends on a few things like whether or not you have to pay your personal margin rate or highest rate (TFN or non TFN)couple of other things like if you qualify for the tax offset. It also depends on the components of the lump sum...

but generally, its 15-40%.... assuming youre withdrawing over the lowest taxable amount (and i dont know what that is).
Everyone is different - you can call them and ask how much.

On another point....I have requested $14,000 for my surgery but I am taxed on that! Any idea how much I will be taxed? It is basically all I have left in my super!

I know the feeling all that waiting! Hang in there, applied 4 funds through APRA on January 23rd, & I finally got approval on March 10 !!!! as long as u have supplied all the relevant info & put in the ewxact wording, u should be fine. Its the nmost frustrating thing waiting, but think of the light @ the end of the tunnel! Good luck.

Where do you live maybe someone can suggest a helpful GP to you?

How long does it normally take for the Super fund to give you the money ours have said 10 working days!!! All this waiting is soo frustrating

Crystal,

DO NOT GIVE UP! See another doctor, different clinic, get a copy of your medical records and go to a different doctor. I saw one of my normal doctors first, and she refused on the grounds that my only problem was my weight. I then saw another doctor (the one that I like the best) and she looked at the letter the surgeon wrote and said that if he said it was life threatening, the she had no problem writing the letter.

On my application, I wrote to them last week and I have to try again on the 26th, and on the 13th March they were assessing applications sent in on the 30th January. So fingers crossed for my approval!

11 weeks till surgery!

im sorry about you gp's i cant beleive they would do that if i was you id go to another clinic and see any doctor and explain that you are trying to do something to make a positive change in you life and you want to live a healthy and happy life and the band will help you do this. Tell them all you know about the operation and that this is what you want.

I can't believe it .. either I just picked 2 unhelpful GPs or I'm fighting a hopeless battle. The GP I saw this morning already had a heads up on my original GPs refusal to write me a letter (same medical centre). He gave me a long lecture on how morbid obesity is only life limiting not life threatening. When I asked him to consider writing a letter saying I had a chronic mental illness, he said only a psychiatrist could write a letter saying that ... even though my depression has been treated at this medical centre for at least 5years and should be well documented. When I argued this and asked why I hadn't been referred to a psychiatrist years ago if they weren't qualified to diagnose depression .. he said it was up to me to have requested a referral. He then went on to say that I was fortunate the first doctor had given me a referral for lapbanding .. he wouldn't have because as far as he was concerned if I made an effort to eat healthy and exercise more I wouldn't need lapbanding. Well ... at this point I completely lost it .. told him he was no help at all and an arrogant pig and stormed out without paying the bill. Made me feel slightly better .. but I'm still without the letter I need. Today has not been a good day!!!

I would with NO hesitation, change my GP. One reason being once you are banded, you need the support of your GP along the journey.
good luck and don't give up.My best friend has Bi Polar, and she has been banded aprox 5 years.

OMG I truly can't believe it. I spoke with my GP today who knows that I have suffered with depression for many years and that I still require 2 meds to keep my mood reasonably stable. She still refused to write me a letter saying that I have a chronic mental illness... because .. wait for it... my depression is stable and under control!!! I argued that if I stopped taking my meds for any more than a day or two, I would be extremely unstable and possibly suicidal .. and her reply to this was that it would be stupid of me to not take them. I even argued that people with hypertension have controlled blood pressure with meds, but they still have hypertension. Seems like I'm getting nowhere with this GP .. so off to see one that surgeon's secretary suggested. Fingers crossed (and toes) that he will be much easier to convince .. wish me luck !!!

dear Pyretta i read your blog on depression i receive disability for depression and i am severely overweight my depression has been the cause of my weight gain as well as fibromyalgia and disc problems i have been seeing a therapist and a psychiatrist as well as taking the meds prescribed i receive Medicaid through disability please advise me how i can get this procedure the lap band i feel at this point it is my only hope now as i continue to grow morbidly obese this is causing my discs to slip and my depression to worsen is there a way i can this done with the help of my psychiatrist or therapist or family doctor please help

YAY!!! I'm so excited, I can finally pay my boss back for my surgery.

Crystal,

if you have been diagnosed with clinical depression then that constitutes a life threatening illness in itself. If it is linked to your obesity then there should be no hesitation in your doctor writing the referral. If you have been seeing a psychologist or psychiatrist they could write the reference for you too.

Still no luck getting the super letter I need ... waiting for an answer from the doctors where i work. Was wondering if anyone had used a chronic mental illness to access their super rather than the life threatening illness reason. I have been chronically depressed since my son was born over 16yrs ago and believe my weight truly drives this depression .. when I'm able to lose weight my depression disappears but comes roaring back when I fail again. I'm starting to worry how my mental health mite cope if the whole lapbanding thing falls through now.

Good news. I went to a random GP this morning and got my letter. He took one look at my BMI and was quite happy to support my decision and wrote a fabulous letter. Its a huge relief. My own GP is very old-fashiones and admitted that he was skeptical about the procedure. He even reeled off stats which were uninformed about how many have died from having it done etc etc.

Good luck with yours Crystal. I'm applying to QSuper too. Will let you know how I go if you like.

I'm in the same position .. my GP wrote me a referral but won't come to the party with the super letter. I sent an email to the director of medicine at the hospital where I work, knowing this doctor is very probanding. I'm still waiting for a reply as I only sent it last night .. but fingers crossed. Qsuper told me the letters only have to come from two doctors .. one being the lapband specialist and didnt matter who wrote the other one. I'm going to hassle every doctor I can think of until I get the letter I need lol.

has anyone gotten a support letter from a random doctor as opposed to their family GP? Is it a long shot? Mine doesn't support lap band surgery - he's extremely skeptical of it. Help! My application is complete except for one measly letter...I have one from my surgeon but need one more!

I was recently rejected on the ground that I wasnt suffering a life threatening illness or chronic pain

I have new letters from my surgeon and GP saying that I have chronic pain and that I suffer from a life threatening condition.

Dont know if the wording illness or condition mean the same thing.

Anyway here is the letter I am attaching would be good if anyone has thoughts on it or suggestions

Letter

I am writing to appeal the decision to deny me access to a portion of my superannuation for gastric banding surgery.

My weight prior to surgery was 165.5 kg this is a life threatening condition as stated in the letter from my surgeon. I also suffer from chronic pain in my lower back hips knees and ankles which exacerbates the problem as I am unable to exercise sufficiently to help lose the weight to help address the problem of chronic pain caused by carrying the extra weight.

In support of my appeal I have attached letters from Doctor Smith my surgeon, my local GP Doctor Jones and another local GP Doctor Brown.

With the supporting documentation I have provided I believe I meet the criteria for early release of superannuation on medical grounds as stipulated by APRA. I suffer a life threatening illness, chronic pain and the treatment is not readily available through the public health system.

The decision to deny my request for early release of superannuation on medical grounds has left me in a difficult position financially. To pay for my surgery I had to increase the limit on my credit card and pay for the entire operation on my credit card as a loan. This has left me in a very difficult position financially.

I'm applying directly to Qsuper also for my surgery and have been told they aren't as difficult in releasing funds as APRA. However,I'm another morbidly obese (BMI 43) female with NO other comorbidities but a strong family history of obesity related illnesses. My GP was more than happy to write me a referral to the surgeon but found it difficult to write me a letter actually saying I have a life threatening illness. Instead she wrote "likely to limit her life expectancy although it is difficult to say how much'. After reading of other ppl's problems with the wording of their letter for superannuation, I'm really worried that this won't be good enough. I don't see the surgeon until the 24 March and was wondering if i shouldn't try other doctors until I get the wording I need.

Has anyone else dealt with Qsuper and are they as uptight on the wording as APRA??? Any advice would be appreciated :)

Have you used the allsuper directory (www.allsuper.com.au)? I think this is a good directory in which you can find a lot of superannuation info.
