claiming the loan as a tax deduction is irrelevant, the criteria is if it was used for income producing activities.

If this was your principle (IE: you both lived in it prior to divorce and it was not used as a rental or the loan against it was not claimed as a deduction) residence then there is no CGT.

can anyone tell me where to find information on whether cgt can be deferred when a principal residence is sold as part of a divorce settlement and the two partners buy residences separately
